Environmental Protection Act

On October 31, 2011, the Ministry of the Environment’s much anticipated modernized approvals system came into effect in Ontario. As of this date, Parts II.1 (Environmental Compliance Approvals) and II.2 (Registrations) of the EPA are in force. The separate Certificates of Approval previously required by sections 9 (air and noise) and 27 (waste) of the EPA, and section 53 (sewage works) OWRA have been replaced by Environmental Compliance Approvals that may be issued for multiple activites at a site.

Certain heating systems, including HVAC systems, standby power systems and automotive refinishing facilities may now be registered in MOE’s Environmental Activity and Sector Registry.

For air emissions, Ontario has a new Environmental Registry known as the Environmental Activity and Sector Registry (EASR).

On June 14, 2011, a decision was made  to approve Ontario Regulation 245/11  (the notice of proposal and supporting documentation can be found here) under the Environmental Protection Act. This regulation defines those activities that are eligible to be registered on the EASR. This new registry will be administered by Service Ontario and will focus on air emissions for standard and routine-type activities and sectors, including automotive spray-paint shops, comfort heating providers, and emergency (standby) power operations.

Beginning October 31, 2011, eligible businesses will be able to register these prescribed activities and the public will also be able to access the registry on-line at www.serviceontario.ca.
